Beefheart recorded a new album for Warner Bros. Shiny Beast (Bat Chain Puller), with no involvement from Cohen or Zappa. Following a lawsuit which was settled in 1982, the album remained unreleased until 2012, after Zappa's family had announced in 2011 that they would release the original Bat Chain Puller in its intended form. After recording the album Bongo Fury with Frank Zappa, Don Van Vliet formed a new Magic Band and began recording Bat Chain Puller for DiscReet and Virgin Records. Zappa described the proposed album as Vliet's best since Trout Mask Replica. Vliet co-produced it with Kerry McNab, who also served as the remix engineer on Zappa's. In 1982, Cohen settled his lawsuit with Zappa, while Vliet was recording Ice Cream for Crow.

Captain Beefheart and his Magic Band signed to A&M and released two singles in 1966. The first was a version of Bo Diddley's "Diddy Wah Diddy" that became a regional hit in Los Angeles. The followup, "Moonchild" (written by David Gates, later of the band Bread) was less well received Safe as Milk. The Captain and his band members were initially denied entry to the United Kingdom, because Meaden had illegally booked them for gigs without applying for appropriate work permits. After returning to Germany for a few days, press coverage and public outcry resulted in the band being permitted to re-enter the UK, where they recorded material for John Peel's radio show. Producer Frank Zappa was then able to record most of the album in less than five hours.

Their music was characterized by bluesy melodies, shambolic instrumentation, idiosyncratic, unbound timings, the growls and shrieks of Beefheart's vocals and his surreal, poetic lyrics.

Captain Beefheart and the Magic Band chronology. Released in 1978, the album was produced by Captain Beefheart and Pete Johnson and released by Warner Bros. Shiny Beast emerged from the production difficulties surrounding Bat Chain Puller, an album Captain Beefheart recorded for DiscReet and Virgin Records in 1976. DiscReet cofounders Herb Cohen and Frank Zappa feuded over the production of the album, because Cohen funded the production with Zappa's royalty checks. Captain Beefheart recorded a new album, Shiny Beast (Bat Chain Puller), due to Zappa withholding the master tapes of the original Bat Chain Puller album. Shiny Beast was praised by music critics.

Notes

The cover is red on green (front) and green on red (back).
The centerlabels are fakes of the Eurodisc label.
All mistakes in the track titles as on release:
A2 on both Cover & Label "When I See Mommy I Feel Like A Mommy", not "When I See Mommy I Feel Like A Mummy".
B3 on both Cover & Label "Floppy Boots Stomp", not "Floppy Boot Stomp".
B4 on both Cover & Label "Ode A'Alex", not "Ode T'Alex".
B6 on Cover "Human Totem Polo" (on Label the correct "Human Totem Pole")

Tracks A1, A5, A7, B1 to B4, B6, B7 are from the tapes which emerged from the sessions of an album to be titled "Bat Chain Puller", begun under the production of Frank Zappa. The project went into limbo as a result of legal wrangles caused between Zappa & Cohen (his manager) in the winding-up of the "Straight/Bizarre" labels.
An official 2012 recording has been released of the work completed on the project; Beefheart* - Bat Chain Puller

Additional to the "Bat Chain" material;
Tracks A2 & A3 were recorded live at 'My Fathers Place', New York, 11th December 1978.
Track A4 is from an interview with John Peel, done in 1973.
Track A6 is a rendition of "Seam Crooked Sam".
Track B5 is a rendition of "Odd Jobs".
The inclusion of "81 Poop Hatch" suggests this album was released after 1982 (when that track 1st appeared).

Sound levels change dramatically between live & studio tracks. The speed of the recording is also too fast, in comparison with tracks appearing on other releases.

The front cover has the additional strapline; "dertotempolesagtmanstehtaufdemgrund" (on front & back).
On label (side 2): DER TOTEM POLE SAGT MAN STEHT AUF DEM GRUND"
